Lady left in constant pain following wrist surgery receives compensation of over £400,000

Mrs C has recovered compensation following wrist surgery carried out in 2010.

Mrs C attended her GP in June 2010 complaining of pain, pins and needles and numbness. The GP thought she would require a simple operation and referred her to an NHS Treatment Centre. A consultant orthopaedic surgeon examined Mrs C and, following investigations, advised replacement of part of her wrist (right distal ulnar replacement).  However, following the operation, Mrs C struggled with pain and underwent further surgery.

In August 2012 Mrs C underwent surgery to remove the replacement ulnar.  However, despite physiotherapy and several steroid injections, she continued to have pain and her wrist remained stiff.  Mrs C underwent a total fusion of her wrist on 29 December 2014.  Sadly, she continues to have pain today, and is due to have further surgery.

As a consequence of the operation in 2010, Mrs C was given ill health retirement and has been unable to drive or ride her motorbike.  Her passion in life was riding her motorbike and, before her ulnar replacement, her social life revolved around biking.

Mrs C’s case was based on the fact that she had an unnecessary ulnar replacement operation and, when carried out, the position of the implant was unsatisfactory, and the implant subsequently failed.  However, rather than addressing the implant, the surgeon recommended ulnar osteotomy, which was unnecessary and inappropriate.  The Claimant’s case was that, but for the negligence, she would not have required any operations and would have suffered no more than relatively minor symptoms, which would have either resolved or been managed by conservative measures.

The case settled, two months before trial, for over £400,000.
